1. Acceptance of Terms

By downloading, installing, or using Perfect Pitch ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Perfect Pitch is a mobile application designed to help users develop and improve their ear training and pitch recognition skills through interactive exercises and gamification.

3. User Accounts

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

You must provide accurate and complete information when creating an account.

4. Subscription and Payments

Free Tier: Basic features are available for free with limitations.

Premium Subscription: Enhanced features require a paid subscription. Subscriptions are billed through Apple's App Store.

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your Apple ID account settings
• No refunds for partial subscription periods

Lifetime Purchase: A one-time purchase grants permanent access to premium features.

5. Acceptable Use

You agree not to:

• Use the App for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App
• Harass, abuse, or harm other users
• Share your account credentials with others
• Manipulate leaderboards or achievement systems

6. Intellectual Property

All content in the App, including but not limited to text, graphics, logos, audio samples, and software, is the property of Perfect Pitch or its licensors and is protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the App without our explicit permission.

7. User Content

If you submit content to the App (such as a profile picture or display name):

• You retain ownership of your content
• You grant us a license to use, display, and distribute your content within the App
• You represent that you have the right to share such content

8. Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that:

• The App will be uninterrupted or error-free
• The App will meet your specific requirements
• You will achieve any particular learning outcomes

Perfect Pitch is an educational tool and should not be considered a substitute for professional music instruction.

9. Limitation of Liability

To the maximum extent permitted by law, Perfect Pitch shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App.

10. Termination

We may suspend or terminate your access to the App at any time for violations of these Terms or for any other reason at our discretion. You may also delete your account at any time through the App settings.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Perfect Pitch operates, without regard to conflict of law principles.
